Welcome to Kalavati Nursery. By availing our planting, landscaping, or maintenance services, purchasing plants, or using our website, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before proceeding with any order or service.
1. Scope of Services
Kalavati Nursery provides plant sales, garden setup, landscaping, maintenance, and related consultation services. The exact nature of services will be detailed in the quotation or service agreement shared with the client. Any additional work or variation requested after the agreement will be subject to a revised quotation and timeline.
2. Orders and Payments
All orders must be confirmed in writing or through our official communication channels. A minimum advance payment of 50% of the total quoted amount is required before work begins. The remaining balance must be paid immediately upon completion or delivery, unless otherwise agreed in writing. Payments can be made via cash, bank transfer, or UPI to Kalavati Nursery’s authorized accounts only.
3. Pricing and Quotations
All prices quoted are valid for 15 days from the date of quotation unless otherwise stated. Prices are subject to change based on plant availability, market rates, transportation costs, and seasonal variations. Any government taxes, levies, or charges applicable at the time of billing will be borne by the client.
4. Plant Availability and Substitution
While we strive to supply all plants as described, certain varieties may be unavailable due to seasonal or supplier constraints. Kalavati Nursery reserves the right to substitute plants of similar type, size, and value, maintaining the overall design and quality agreed upon.
5. Delivery and Installation
Delivery dates are provided in good faith but may vary due to weather conditions, transport delays, or other unforeseen circumstances. Clients are requested to ensure accessibility to the site during the installation period. Any additional cost arising from restricted access or delays caused by the client will be chargeable.
6. Maintenance and Plant Guarantee
Kalavati Nursery ensures all plants are healthy at the time of delivery. However, plant survival depends on proper watering, soil condition, sunlight, and care after installation. Once plants are handed over, we are not liable for damage or death caused by neglect, improper care, weather, or pest infestation unless the client has opted for our paid maintenance service.
7. Cancellations and Refunds
Cancellations made within 24 hours of placing an order will be accepted without penalty. After this period, refunds will be subject to deduction for plants procured, labour scheduled, and other incurred costs. No refunds will be issued for completed or partially completed projects.
8. Liability
Kalavati Nursery shall not be responsible for any indirect, incidental, or consequential loss arising from plant failure, delayed service, or other unforeseen circumstances. Our total liability, if any, shall not exceed the amount paid by the client for the concerned service.
9. Intellectual Property
All designs, layouts, and images created by Kalavati Nursery remain our intellectual property unless otherwise stated. They may not be copied or reproduced without our written consent.
10. Governing Law
These Terms and Conditions are governed by the laws of India. Any disputes shall be subject to the jurisdiction of the courts located in Pune, India.
